Czech gay test for asylum seekers condemned

9 December 2010

The European Union’s Fundamental Rights Agency (FRA) has said that the Czech authorities’ “phallometric test” could be in violation of the European Convention on Human Rights, as it “touches upon the most intimate part of a person’s private life”.

Men claiming asylum because they are gay are hooked up to a machine which measures the flow of blood to their penis when shown heterosexual pornography.

If they are aroused, then they are denied asylum.

Replying to the FRA’s criticisms, the Czech interior ministry claimed that the procedure has only been used in fewer than ten cases, with the asylum seeker’s consent, and in the presence of a medical doctor.

The FRA said that the Czech Republic was the only EU country still using a “sexual arousal” test.
